A woman who worked as a nurse in Ontario, Canada has been arrested and charged with killing eight elderly residents at two different nursing homes. Although the investigation is ongoing and details are not widely known, police say the victims were given a drug, which led to their death. Victims were dated back to 2007, with the most recent being in 2014. The alleged murders come as a devastating shock to those families who lost a loved one. But it also serves as a scary reality of the abuse, neglect and heinous acts that could take place in nursing homes.
That is why the Phoenix personal injury lawyers at Knapp & Roberts want to help families make the best, most informed decision when finding a safe nursing home for their loved one. Here are 3 easy steps you should follow before admitting your loved one to a nursing home:
Step 1: Conduct research online. Decide the area you’d like your loved one to live and use websites like U.S. News and World Report and for those in Arizona, the Arizona Department of Health Services, to narrow down your search even further. U.S. News and World Report is a great place to start, showing an “overall” rating, as well as ratings for health inspections, nurse staffing, quality measures, penalties, and health inspections. Once you narrow down your search to top three homes, check AZDHS website to look deeper into the home’s inspections and any penalties that were received.
Step 2: Schedule a tour with the nursing homes you narrowed down in step 1. You’ll want to read our blog on What to Look For on a Nursing Home Tour before going on a tour.
Step 3: Choose your favorite from the tours and continue with the process of getting the contract. If you receive a contract before November 28, be on the lookout for language regarding mandatory arbitration agreements. Effective November 28, mandatory arbitration agreements have been banned by the U.S. Department of Health and Human Services. However, homes may still ask you to opt in to an arbitration agreement. We recommend you not agree to an arbitration agreement. Click here to learn why.
People enter nursing homes expecting to be treated with respect and care; and the United States, especially through Medicaid and Medicare, spends extremely large amounts of money to achieve this; but the all-too-frequent stories of nursing home abuse and neglect clearly indicate that the pervasive failure to deliver. While courts and juries tend to be sympathetic to nursing home residents who have been assaulted, neglected, or even killed at the hands of their caregivers, that doesn’t make up for the experiences of the victims or the horror experienced by their families.
